OVERVIEW

This website and online store are operated by Soft Tide. Throughout these Terms of Service, “we”, “us” and “our” refer to Soft Tide.

These terms apply when you visit softtide.com.au, use our online store or purchase a product from us. By using the store or placing an order, you agree to these terms together with our Privacy Policy, Shipping Policy and Return and Refund Policy.

PRODUCTS & ARTWORK

The format and inclusions for each product are stated in its listing. Unless a listing expressly states otherwise, Soft Tide fine art prints are physical, unframed paper prints. Frames, mats, styling props and other decorative items shown in product images are not included, and no digital file is supplied.

We make reasonable efforts to display product images, colours, sizes and details accurately. Colours may vary slightly between screens and the finished print because of screen settings, paper and printing processes. Room images are styling mock-ups and are intended as a visual guide only.

ORDERS

Submitting an order is an offer to purchase. An order is accepted when payment is confirmed and the order enters production or we otherwise confirm acceptance.

We may decline or cancel an order if payment is not authorised, information is incomplete, a product or delivery service is unavailable, there is an obvious pricing or description error, or fraud or misuse is reasonably suspected. If we cancel an order after payment, we will refund the amount charged for the cancelled item or order.

PRICES & PAYMENT

Prices are displayed in the currency selected or shown by the store. Shipping is charged separately and calculated at checkout.

By submitting an order, you authorise us and our payment providers to charge the total amount displayed at checkout. International customers may also be responsible for import duties, taxes, customs charges or other local fees as explained in our Shipping Policy.

MADE-TO-ORDER PRODUCTION

Our physical fine art prints are professionally produced to order. Production can begin shortly after an order is placed, so changes or cancellations cannot be guaranteed and are not accepted once production has begun.

Please review the artwork, size, delivery address and other order details carefully before completing your purchase. Contact us immediately if you notice an error.

SHIPPING & DELIVERY

Shipping availability, charges and estimated delivery times are explained in our Shipping Policy. Delivery dates are estimates unless we expressly agree otherwise and may be affected by production times, carrier delays, customs processing or other events outside our reasonable control.

RETURNS & ORDER ISSUES

Because physical prints are produced to order, we do not accept change-of-mind returns or exchanges, except where required by applicable law.

If your order arrives damaged, defective or incorrect, please follow the process in our Return and Refund Policy. Nothing in these terms limits any rights or remedies available under applicable consumer law.

INTELLECTUAL PROPERTY

The artworks, photographs, designs, branding, text, graphics and other content displayed on this store are owned by or licensed to Soft Tide and are protected by intellectual property laws.

Purchasing a print gives you ownership of that physical copy only. It does not transfer copyright or give permission to reproduce, copy, distribute, modify, resell or commercially use the artwork or store content without our prior written permission.

ACCEPTABLE USE

You must not use the website or its content for any unlawful, fraudulent or harmful purpose, attempt to interfere with the operation or security of the store, or use our artwork, images or content without permission.

THIRD-PARTY SERVICES & LINKS

Our store is hosted by Shopify and may use third-party providers for payments, production, delivery and other services.

When you visit our store or make a purchase, Shopify processes information about your interactions with our store. Shopify may use this information together with information from your interactions with other merchants and with Shopify to provide, protect and improve its services, including enhanced and personalised services.

Information may be shared with Shopify, its service providers and other third parties located outside Australia or the country where you live.

Your use of a third-party service may also be subject to that provider’s terms and privacy practices.

Our website may contain links to external websites. We are not responsible for the content, availability or privacy practices of those websites.

STORE AVAILABILITY

We may update, suspend or discontinue parts of the store, products or services from time to time. We do not guarantee that the website will always be uninterrupted or error-free, but this does not affect any rights relating to an accepted order.

CONSUMER LAW & LIABILITY

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded under the Australian Consumer Law or any other applicable consumer protection law.

To the extent permitted by law, Soft Tide is not responsible for indirect or consequential loss arising from use of the store or products, or for loss caused by misuse of a product, incorrect information supplied by the customer or events outside our reasonable control.

CHANGES TO THESE TERMS

We may update these Terms of Service from time to time by posting the revised version on our store. The terms in effect when an order is accepted will apply to that order unless a change is required by law.
